Waiver, Release and Hold Harmless Agreement

On behalf of myself, my child, and our heirs, next of kin, assignees, and personal representatives, I represent, covenant, and agree as follows: I acknowledge that my child is participating voluntarily as a soccer player in the Melrose United LLC (“Melrose United”). I further acknowledge that my child’s participation in Melrose United involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage or other harm could occur to my child or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from his or her participation in Melrose United activities (“Activities”), regardless of whether caused in whole or in part by the negligence or other fault of Melrose United and its agents, employees, staff, or volunteers (“Released Parties”). As used in this Agreement, “Activities” includes, without limitation, practices, scrimmages, games, meetings, parties, and travel to or from such events. As used in this Agreement, “Released Parties” includes, without limitation, Dean Serino, Bert Stoker, Alex Kakambouras, Rob Mahoney, Heather Mahoney, Anthony McElligott, Connor Gilbert, Nathan Terry, Hannah Butler, Olivia Downey, Hailey Rodriguez, Jill Stone, Sue Tremonte, Eli Ellis, Paul Wiesen and Paula Vaughan. I waive all claims against any of the Released Parties for any injuries, damages, losses or claims, whether known or unknown, which arise during or result from my child’s participation in Melrose United Activities, regardless of whether caused in whole or in part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys’ fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits brought by me, or by or on behalf of my child, against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from participation in Melrose United Activities, regardless of whether caused in whole or in part by the negligence or other fault of the Released Parties. Photo Waiver I hereby grant permission to Melrose United LLC (“Melrose United”) to photograph and to publish photographs of my Child on the Melrose United website, as well as in brochures or other promotional materials that Melrose United may create and distribute from time to time. I hereby waive all rights of privacy and/or compensation for me or my Child that I, or he or she, may have in connection with the use of his or her photograph or likeness in connection with said Melrose United website, brochures, or other promotional materials. I acknowledge that the Melrose United, should it publish photographs of my Child on its website, or in brochures or other promotional materials, will not identify my Child’s name. I, for myself and my Child and our respective heirs, administrators, successors and assigns, hereby release Melrose United from any and all claims, liabilities or damages arising out of, or in connection with, the use of my Child’s photograph or likeness by Melrose United on its website, or in Melrose United brochures or promotional materials.
